Yes, they can provide(sell) facilities to the NSA.

It's just that AT&T can't connect them to lines carrying US based customer traffic without breaking several laws.

The EFF is charging AT&T with breaking those laws.

(I.E. Wholesale domestic wiretaps without a warrent.)

It is well established in Tort law, that automatically declares any contract invalid, (I.E. NSA & AT&T), if it involves the breaking any state or federal law.
