OK, as you requested:
I am not opposed to police seizing encryption keys as part of a warrant. We'll assume the warrant process is fair. (Not sure that's always true in the recent war on terror.)
But I am opposed to anyone other than a very, VERY limited number of people seeing the contents of the files (unless of course they do turn out to be evidence) and opposed to records being kept as to the contents of the files (unless, of course...). The US government has a poor track record of protecting private data lately... just ask the vets.
I am also strictly opposed to requiring the defendant to provide the key - I think that's tantamount to incriminating yourself. If the cops can't figure out how to get in, the defendant should not be penalized for not telling them. A defendant should have the right to stand mute in their defense.
Would it be reasonable to penalize someone for not telling where the body is in a murder case? Even if they didn't commit the murder and don't know? The law accuses, and they have to make a case without the help of the defendant. If they can't then they're out of luck. Yes it sucks if you're the victim, but it's the fairest way to prosecute in the long run.
