way wrong focus
The problem is, you don't allow someone who is under extreme duress make the decisions. They lack the basic clarity in thought to make wise decisions. Many of us would simply kill the accused (and feel bad later if it turned out we were wrong).
We make laws based on calm objective feeling, not highly aggravated desire for revenge. We're not trying to protect the rights of criminals, but of those who have done nothing wrong but are under attack by law enforcement. In the US our laws are based on the presumption of innocence, and the right to avoid unreasonable search and seizure. Unencrypting evidence is not something any law abiding citizen would object to. Fishing to find something is something we should all fear, no matter how clean our hands.
Think it's not a problem? Think everyone of the detainees in the war on terror is really a terrorist?

PS As to your jerkwad comment further down: you're right, I wasn't joking, I really did have his daughters. Sheesh, what's wrong with you? Of course I was joking. I assume he was too, in implying he'd murder the suspect. Get a life.
