These kids broke in to a private home and stole electronics. Behavior of common criminals, not data theives. Your punishment assumes they were after the data.
I suspect the contents of the laptop were totally irrelevant to their crime. They may or may not have accessed the data, they may or may not have made copies. I'd bet not. If we find copies, things change, and the release of the data would be a separate crime from the theft of the hardware. Harsh punishment would be in order at that point.
Had they targetted the VA and the data, your comments would be on track, but I suspect you want to punish the theives for the sins of the data managers. That makes no sense and will not help improve the security of corp and gov data one iota. True improvement in society will come from addressing the real problem, not the scapegoat.
