What good does encryption do?
The whole concept of fileswapping is giant network of P2P software allowing you do search for songs from anyone making the avaiable. What good does encrypting the transfer do or encyrpting the song do. The person downloading has to be able to unencrypt the song. So if you make it available obviously you are supplying the means of decrypting the file.

Now if you talking about email a song to friend, no problem. That fall squarely into fair use. It's only illegal when make a song available to anyone using the P2P software and if you are doing that encryption is meaningless.
