... the people who should be convicted are the slobs that left unpatched and unprotected systems attached to the public network where a complete twonker like McKinnon could just wander in.

In my book, that's called negligence or possibly incompetance depending on the skill level and amount of laziness involved.

The office server here gets an automated attack every few hours - at least one attack a day, but usually more - and in three years it has never been penetrated. That level of defense required very little effort to achieve. If a small company can do it, surely the US Govt can do it too???

and neither do you. For all you know there was nothing of any use on them at all. If they were supposed to hold secure data then the system admins are the ones who are responsible for failing in their duty. You don't put sensitive data on a unprotected machine.

So he's guilty then? Well that saves the trouble of holding a trial. Shall we just throw away the key together with his civil rights?
