>> While spam is a lowlife approach to marketing, I fail to see the grounds for considering it an illegal activity <<

From the article:
Spam has become a consumer headache and corporate nightmare: It costs U.S. companies an estimated $1 billion per year in security, human resources and productivity. And various companies estimate that it comprises at least 50 percent--and possibility as much as 90 percent--of all e-mail.

Don't you consider something that costs A BILLION dollars for companies to deal with it something that should be illegal?

At the very least, charge these people with fraud for forging the message headers.

SPAM renders e-mail virtually useless. I receive several HUNDRED spam messages per day.. more than 95% of my inbox. You're telling me that something that completely ruins the e-mail account that I paid for completely legal? So I guess you're in favour of spamming mobile phones or fax machines, too? After all, it's just a "lowlife approach to marketing".

>> Most of it stems from the user's irresponsible actions. Not reading fine print, failing to understand what checking or unchecking a box on a web site they have interacted with, etc. If one were to read the info on most sites when interacting with those sites, most spam would prove to actually be solicited by the user. <<

Absolutely not. Do you even work in the IT industry? By comments like this, I think not..
