Why should he be the only one to pay? The companies he promoted through spam should be hit very hard also. The businesses that think it is OK to use a spammer will just look for someone else to carry their message. Lets face it - if you flood the Interent with 25 million messages per day and the response is .001% that would look like good odds to a business. So the second tier needs to be charged with spam as well, since they knowingly paid their money for the service. Currently it is good for them, they advertise - he pays the penalty. Make a few pay a heavy price and see how attractive it looks to them then. It would only need a couple of heavy hitters to go down aand the industry would collapse like a house of cards. Big business - huge fines are the way to go.
