Maybe, and maybe not

The Can Spam act is not perfect, or even close to perfect, but it beats the heck out of nothing.

Here is why nothing could be better. Since opt-out is the rule, spammer does not have to disclose how it got your email address. If it provides a legitimate snail mail address and an unsubscribe link, then it is within the law. If you unsubscribe like a true sucker, I mean law abiding citizen, then it will never send you anything again. It may sell your email address to 5 or 10 other spammers who will then legally spam you and then sell your email address again. Now do you get it? Change opt-out to opt-in and be able to prove you obtained the email address legitimately, and you have something with some teeth. You don't have any reason not to use an opt-out link from someone who obtained your email address legitimately.
