I think you know who "does the deeming"
Everyone agrees that "there should be an appropriate amount of surveillance in America". The disagreement lies in what is considered "appropriate", and who gets to make that decision.

The normal people (i.e. those who hate the Bush regime) feel that there should still be three co-equal branches of government, with the courts issuing warrants where applicable, and the executive only snooping as needed and allowed.

The Bush regime and its addled-brain supporters, on the other hand, feel that everyone in the world is fair game, and that only the "unitary executive" is needed to establish who and what should be snooped on. FISA means nothing. The Fourth Amendment means nothing. Reporters and whistle-blowers who shed light on blatant violations of federal law and the Constitution itself are threatened with prosecution under a 1917 law.

Yet, ironically, Bush insinuated that the 1978 FISA law was inapplicable, because it's so old.

How many people are aware that Michael Hayden killed a program that would have mined phone-related data, yet secured privacy and the Constitution at the same time? (It did this by mining data, but encrypting it, with a warrant being required to decrypt any specific part of it.)

That program was partially scrapped, so that only the pure data-mining portion was left intact. The encryption portion of the technology was thrown away, deemed needless.

What's it gonna take?
