Microsoft are therefore confident of not being hammered by the courts, or quite willing to pay up if they are. Those options could well explain why they "can be sure" that Vista will ship on time.

However, if Symantec's position is strong then it is possible that a court could order a halt to Vista (presumably if the damage to Symantec was larger than could be covered by a cash settlement). So, Ballmer being confident is more like a probability, not a certainty.

Remember too that they (Microsoft) were confident about their position with Sun on Java.
