The question isn't whether telcos gave records to the NSA...
...the question is whether or not the records they gave constituted an illegal breach of the privacy of their customers.

One one side you'll have the government shills saying that the NSA can do whatever they please, and on the other will be the anti-government shills claiming that the NSA (along with the telcos) should be tried, convicted, and executed by the end of next week.

The rest of us will sit back and try to determine for ourselves if 1)any laws were broken, 2)the privacy of the telco customers was breached, and 3)if either of those conditions are acceptable in order to prevent further terrorist attacks launched from our own soil.
