This is a denial of service attack. I agree on that part. But if they dont have an applicable law for it.. oh well. Bet they will now.

As far as your scenario goes.. you could just ignore the people knocking. Just like a server could be configured to only allow 10 emails from one server at a time or block emails from a provider if a email threshold for one day is met.

I would compare an email server to an answering machine rather than a front door. It just kept taking messages until it ran out of space(or processing power). Just like the answering machine, it didnt know when to stop. Yes it was done intenionally, but there is no law against filling up someones answering machine with useless message(yet).
