Law was not written to stop SPAM
CAN-SPAM created penalties for forging headers and resource abuse within the physical borders of the USA. The law also provided guidance on proper opt-out behavior of the SPAMMER. Of course, none of this does anything to stop unsolicited commerical email and is unenforceable on anyone outside US borders. CAN-SPAM, in essence, endorses SPAM as long as you do not forge headers, abuse the resources (i.e. bounce mail off the servers of others) or fail to honor opt-out. CAN-SPAM provides no resources to Federal, State or Local enforcement of the law. CAN-SPAM was really the legal endorsement of SPAM as envisioned by the Direct Marketing Association and other marketing organizations. Better consumer privacy or SPAM reduction are not the aims of the legislation.
