No more so than tresspassing is. Tresspassing is completely legal if you don't tell the person they can't do that. Now chance are the government site should have had a warning somewhere but if they didn't well then this guy is innocent.
On top of that you also need the policy to back up the warning. With out that policy this guy gets off scott free. Chances are they have those policies in spades as governments love policies.
So it's only illegal if you inform people that it is is and you have the policies to back it up other wise you're just another public space waiting for someone enter.
