If it looks like spam, and smells like spam ....
It's probably spam.

I've installed dozens of anti-spam systems, and tried everything out there. The common thread among most anti-spam strategies is "democracy". That is, the mail system users "vote" on what they think of an email, by reporting it as spam, or by retrieving suspicious looking commercial email from their junk folder. Those votes are then used to train the various filters at the smtp front gate. Users report they "like" this feedback loop, it "feels right" to them. It's grass-roots justice.

Sender reputation is already established by the recipients. If your mailout has a bad reputation, it's probably deserved. So say the people.
