EXACTLY the conversion I (corporate IS Security) and my IS Manager had about a week ago.

Wire-fraud is Wire-fraud...a law already exists regardless of the technology used to commit it (see federal law below - under Chapter 63 Mail Fraud).

Section 1343. Fraud by wire, radio, or television

Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, transmits or causes to be transmitted by means of wire, radio, or television communication in interstate or foreign commerce, any writings, signs, signals, pictures, or sounds for the purpose of executing such scheme or artifice, shall be fined under this title or imprisoned not more than 20 years, or both. If the violation affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both.

For example, a bogus/scam company has a voice recording of a Sr. Citizen aggreeing to some offer over the phone. The offer turns out to be a ruse/scam/bogus...the company still gets prosecuted for running the scam...the agreement is struck as invalid due to the nature of the offer.

Parrallel that with clicking "Yes" on the EULA for a "screen-saver" that allows the installation of tracking software that continues to download more junk for the sole purpose of making money for the company that wrote/provided the software. It's a bogus offer. Also, who's to say that a 14 year old clicked on it...they can't sign contracts. Many angles to go after the "trouble-makers" on the internet without infringing on the holy-grail of free speech.
