Microsoft is missing a golden opportunity
As the article states, the genie is already out of the bottle. Rather than fretting over the trading of the source code and the illegal use thereof, they should just see what comes of this public release.

Perhaps the evaluation of this small portion of code could provide MS with insight into ways of improving their code and their development processes. Surely vulnerabilities have and will be found. So what? Everyone knows those bugs exist and will continue to be discovered and exploited. This may actually speed up the discovery process.

I don't know if open source is the answer or not. I do know, however, that this leaked code is now open source (although not in the legal sense) and that this particular portion of the OS will never again be secret. All of the laws and the lawyers in the world will not make it so. Consequently, they should take this opportunity to see what develops from this.
