How it affects freedom

In the absence of independent judicial review, the people responsible for operating a program such as the one the Bush administration is running will eventually come to see themselves as the only people capable of running the program and justify using the program to perpetuate their power by eliminating political opponents. It is precisely this sort of abuse that led to the passage of the FISA act in the post-Watergate years.

The choice is not "between safety and security" as you suggest, but rather between freedom and tyranny. By throwing away our Bill of Rights protections against government abuses, the Bush administration is allowing our enemies to destroy our freedoms -- and without even having to fire a single shot! The Bush administration is at best an unwitting ally of the terrorist extremists who attacked us in 2001; at worst they may be political opportunists exploiting the fear of another such attack for to their own advantage to perpetuate their hold on power and in the process destroying the democratic (please note: lower case) principles and freedoms that have made our country a beacon of hope around the world.
