NSA process precludes probable cause
The methods most likely used by NSA to spy on internet and voice communications precludes probable cause. It is after the communications have been intercepted that they are then scanned, and only after something has been found in the second phase could there be any probable cause. That explains why the Busg Administration did not go to the FISA courts. They would have been denied warrants for this kind of 'fishing expedition'.
