FISA was written to comply with 4th amendment.
The FISA law was written within the guidlines of the 4th amendment. I.E. Court order(Warrent) and sworn testimony are still required. (With some leeway given to the exact timeline.)

"The right of the people to be secure in their persons, houses, PAPERS, and EFFECTS, against unreasonable searches and seizures, shall not be violated, and NO WARRANTS shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Absent the FISA law. Neither the Executive nor the Legislative branches of Government have the authority to wiretap within US. That power is strictly delegated to the Judicial Branch of our government.

I should note: Nothing short of a passage of a NEW constitutional amendment can change it. A declaration of hostillities and/or war does NOT cut it. There is no wavier in the consistution for any of this behavior.

So either the Bush adminstration upholds the constitution as it was written or they don't. They seam to believe in the later, thus they have violated the oath of office, "To protect and defend the constitution", and those rogues should be removed from office.

It should also be noted.. that any employee of a teleco and/or ISP cooperating with this illegal activity is guilty of conspiracy.
