Parasite
That what it is. It should be uninstall, destroyed and remove from all computers on the spot. If anti-virus and firewall companies want to keep a certain credibility they must put they pants on and help eliminate those illegal spyware.

But in the merry land of frivolous law suit and easy to buy puppet judges and government representatives it will never happen. The ? laws, the patent office and the US justice system in general is just a supermarket where any one with enough money can buy in the law they want. Easy examples: All those parasite companies that still business in the US despite they clearly illegal activities: 180solution, First4Internet, Macrovision, Sony (witch as planted illegal software in millions of consumers computer and yet is still in business). Not to mention the Digital Mafia that is the MPAA/RIAA who use illegal spying techniques and take pleasure into suing kids and destroying families all this to keep an abusing monopoly where they STEAL money form everyone artist and comsumers. (1930?s street gangs updated for the 21th century). And the most ridiculous recently is a Cell phone company patenting Smilley!

What next? A patent on the method for breathing!

As long as parasite will be permited to sue, it is just going to be harder and harder to keep a computer running.
