It's not lawful to bypass the FISA court, and for good reason, since Nixon used domestic spying to spy against his political enemies.
The FISA court was put there specifically to check that domestic spying was for USA aims and not power crazed dictator aims.

Gonzales the head of the DOJ understands this well, yet he's touting the Political spin line?

"Michael Hayden, a former NSA director who is now a top intelligence official, went even further. In a speech in Washington on Monday , Hayden said that "had this program been in effect prior to 9/11, it is my professional judgment that we would have detected some of the 9/11 al-Qaida operatives in the United States, and we would have identified them as such."

So he asked FISA to spy inside USA and was turned down then? No? Oh well, I call ******** on that then.

I am so sick of sequels!
