Fine tuning - intent
Just like the difference between 1st and 2nd degree murder is intent, the same should be true of crackers. If you are curious, and hack into a system - you get a less-serious punishment (probation, fines, light jail sentences). If you SAY that you have cracked systems and use the treat to blackmail - then you get the standard blackmail punishments. If you actually make GOOD on your threats - your punishment should fit the crime. Denial of Service punishment = no food, no water, no sunshine, no air, . . .
