Ahem, Read Up...
"The tape was lost while being transported by the United Parcel Service to credit reporting bureau TransUnion."

According to that, it is not the fault of the bank. The tape was in the possesion of UPS. Thus, they are the people that are responsible for the loss. If anyone does get their identity stolen, it should be UPS that has to pay up and such because they were the people that had the tape just before it was lost.
