A large amount of the spam is being sent from unsuspecting machines that have been compromised. If everyone went to jail that was spamming, most peoples relatives would end up there without a clue that they were doing something wrong.

I think the thing to do is hold the spam author (i.e., the source) responsible, rather than an individual's machine. A lot of this spam is sent to guide users to sites. What you do is find the people who own these sites, and you squash them like the bugs they are.
