I agree that it should be punishable, only problem is the intentionally part.. and determining intent.
A large amount of the spam is being sent from unsuspecting machines that have been compromised. If everyone went to jail that was spamming, most peoples relatives would end up there without a clue that they were doing something wrong.
It is a bit of a catch22 to actually catch these guys. This is why I think that the ones that legitimately get caught should be hung up in the town square, but I have a feeling that it 'taint gonna happen.
My thought is to go after any of the companies that are part of spam and distributing product sales. If they are paying the spammers to get their product out, that is where it would hurt the most. Bust and fine a few of these spam companies and you will hurt the spammers....malware spam is a whole 'nudder topic.
