... best source for determining what is classified under the American system and what is not. The NSA and/or the president determined that this program was classified. It is perfectly in keeping within their roles to do so. It is a crime in the U.S. to leak classified information.

Define domestic spying. When a telephone call is between the U.S. and Afghanastan to a known member of Al Queda is that domestic spying? I think not. The whole privacy rulings is based on whether or not there is an expectation of privacy. If you are calling a terrorist, I doubt it is reasonable to expect privacy. This is the same as the guards in prisons listening to prisoners calls or reading their mail.

As to the legality of the situation it is a grey area. Article 2 of the Constitution and a resolution of Congress gave the President the authority to take "all appropriate actions to protect the U.S." It will be up to a court of law to determine if the actions were appropriate. The President also has the power by declaring marshall law to pretty much gut the Bill of Rights under specific emergencies so this whole matter is not as black and white as you guys would like to make it.

Finally it is Congress that has oversight in this matter and they were breifed no less then 12 times.
