Look at what it said in the article: "libertarian millionaire sued the Bush administration, which claims that the ID requirement is necessary for security but has refused to identify any actual regulation requiring it."

An attorney for the Justice Department argued the case. If the identification requirement wasn't law, but an FAA directive, then he could have said so instead of hiding behind "secret law." If this whole thing was caused by an "uninformed airline employee," then why would the Justice Department refuse to identify the regulation or confirm the lack thereof?
