Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

But the airlines are the private sector. They have the right to ask who you are and you have the right to decline. Of course you should get any money back including deposit. If they have to have secret laws, they know damn well the laws will not get passed. If you are going to have a security state, be honest and up front about it.
