Car Analogys & EULAs
When you purchase vehicle, the manufacturer doesn't leave a EULA in a shrink wrapped envelope or on a CD-R saying that the manufacturer is not responsible if the brakes, airbag, automated seatbelts, etc. fail or if the tires blow out, yada, yada.
But you have to purchase the vehicle before one can read the "Vehicle EULA"

When one purchases software, the EULA is shrink wrapped in the box or on the CD-R itself, so you have to open the box to get to the EULA, which basically says if there are any flaws, etc, Whatever Company is not responsible for any damages. Or there is so much legalese that nobody but a lawyer can understand a EULA and once s/w is opened, it is very hard or impossible to take back for a refund!

IMHO, the EULA for s/w should be shown plainly on the box in "layman's" terms. Then one can decide whether or not to purchase the s/w
