...playing devil's advocate here. :S
(I realize I'm about a month behind on this thread).

I don't recall seeing anything in the original article about the software being installed on YOUR own computer without YOUR own consent, EXCEPT in the case of someone else physically (or possibly remotely) logging onto YOUR computer and installing the keylogging software on it. There's no mention of this software piggybacking on some other software install and then hiding from you since you didn't realize you installed it. The uses the company is referring to are

1) An individual user installing it on THEIR OWN PC for the purpose of monitoring its use by their child, spouse, etc

2) A company installing it on THEIR OWN PC for the purpose of monitoring its use by their employees

In the case of home users monitoring children, they do not have a right to privacy from their parent or guardian while residing with that parent or guardian in their own home and for such reason, the PC OWNER (parent or guardian) agrees to install this software of their own free will on THEIR OWN PC. I see no problem with this.

In the case of a company, their intent is to monitor the usage of THEIR OWN PC by THEIR EMPLOYEES which is generally on THEIR OWN TIME. I see no problem with this SO LONG AS full disclosure is given to the employees that their usage may be monitored. A company is within their rights to do so (although communication with those outside the company is more of a gray area). In the long run, letting your users know their usage may be monitored will cut down on time wasted with personal internet usage as well as helping to protect the company from litigation arising from various unmonitored usage.

That said, this program is without a doubt 'spyware' in the most literal sense of the word because it does SPY on the usage of the PC it's on which it's installed.

I just don't get why everyone is freaking out about it like it's something that's being put on THEIR OWN computers without their knowledge. If someone who isn't the owner of your computer installs this software without your knowledge they will be criminally liable.
