Agreed, no one likes Spyware, as a technician I have to deal with it everyday. I think the real complaint about Spyware is that it gets installed unknowingly on "Your" computer. The stuff that I deal with is installed through fraudulent methods, i.e. drive by installs, html based emails, non-disclosure from "Alleged FREE" software. The key here is "Fraudulent Methods". If I so desire and install software on my computer to monitor activity of other users "I have granted permission to use according to my rules" due to activity that causes my computer to fail, a lack of productivity (which as an employer I have the right to see to it that my employees produce and actually earn their salary) or a breech of security that can cause the loss of assets.

I understand the right to privacy and if there is a disclaimer advising the user and gets their consent prior to use that the computer is being monitored for illicit activity. This can hardly be called "Spyware" by the definition "Fraudulent Installs". If Retrocode has a login screen the first time a new user logs on, and gets their digital signature clearly acknowledging that they understand the computer is being monitored. This also goes to my responsibility to clearly advise the "Guest" user that they are being monitored then these conditions rule out the possibility that it is Spyware.

Ok, this means that the disgruntled wife, husband, father or mother will be able to secretly gather data on each other for the divorce attorneys or the fanny paddle. This kind of use is truly spying and is simply unethical and wrong. If Retocode alters their software to advise all users and get their consent prior to using the equipment that is being monitored then I'd say it is not Spyware as there is "Full Disclosure" involved.
