Also, a quick side note...
The real irony of this end run around first-sale by Sony is that it was the first-sale doctrine that very likely saved Sony's US division from being eviscerated by the movie studios (see Universal City Studios, Inc. et al. v. Sony Corporation of America, Inc. et al. or simply "The Betamax Case" for further details).

I imagine that Sony will lose quite a bit of goodwill regarding this decision.
