As opposed to Windows, where you can easily re-compile the kernel without it?
By the way, the DEM confusion was cleared up over two years ago. The linux DRM issue was mainly about rights over signed releases of the kernel. Linus posted a message to the kernel mailing list in early 2003 about it.
There is further confusion because there is a kernel module called 'drm' which is the Direct Rendering Manager, part of the video subsystem. You can see that it is only used by the video module:
