Removing in not a circumventing
The DMCA is for circumventing copyright protections. Removing Sony's root kit is not cicumventing the copyright protection. Hacking Sony's root kit would be however.

This no different than playing DVDs on you PC. You have to install a DVD decoder. Unistalling the DVD decoder does not violate the DMCA.
