Sony has crossed a major ethical line.

A well designed DRM system should not rely on subverting OS functionality to work.

The biggest issue I have with Sony's use of rootkit techniques is that they implicitly sanction the use of the those techniques in ANY software. What happens when every piece of spyware starts using rootkits to resist any removal efforts? Some of those scummy programs already do that, but they are (thankfully) still a minority. When that happens, expect malware clean up to become orders of magnitude harder than running your favorite spyware scanner a few times.
