The original blog clearly noted (several times, if I remember) that the acceptance for the installation of this kind of software was never found in the EULA.

Furthermore, given the current legal climate and hatred towards spyware and malware (even from judges), there is no clear indication that "consent" may be demonstrated by acceptance of the EULA. Just because its in the EULA does not mean its a legal escape clause or some semblance of "consent"... although how binding EULAs are depends on the district and if your state was stupid enough to sign UCITA into law.
