Primary (intellectual) property ownership is established by the act of its creation, and that is a matter of fact. The creator of an idea is its natural owner. Primary property ownership is immutable. The rights that derive from that ownership can be traded. Or stolen.

Of course, there are cases of legitimate independencies, and naturally, new ideas never come from a vacuum -- everybody is standing on somebody else's shoulders. But the theory accommodates those realities.
