Sue - Ummm, why?
Let's see, a class action suit against Microsoft because of a hole that was patched. Let's analyze this a little further:

1) Microsoft released code with said hole
2) Microsoft subsequently released a follow up patch to plug said hole
3) "Victim" disabled or never enabled the OS auto-update feature so said patch could not be automatically applied
4) "Victim" never bothered to check for OS updates so said hole was never patched
5) "Victim" did not bother to purchase or keep an updated anti-virus program so said virus could be installed
6) Idiot PC terrorist decides to write a virus to exploit said hole
7) Low life fraud ring links up with idiot PC terrorist to exploit "victims" using unpatched and unprotected PC's for financial gain

You're right; Microsoft is the culprit! SUE!!!
