Why?
Because of EXTORTION by the RIAA.

Sign this agreement to pay us $10000 (for music you downloaded with maybe a tenth of that, retail).. or we'll sue you for $150000 PER SONG.

That's right, $150000 PER SONG. That the legal remedy the RIAA has available to them. Who the hell came up with the idea that a single song was worth $150000?

Who is going to risk complete financial ruin when caught in the RIAA's radar? In fact, I'll bet a number of the settlements were from people who didn't actually swap anything.. but didn't want to risk their case against the RIAA's group of trained weasals (aka. lawyers).

Until we have a case actually go to trial, fear will make those targeted comply..
