Mind you if a criminal case were to come up it wouldn't be $10,000 it's $500,000 and there is jail time included in that. This what the copyright infringement laws state when you view them pior to DVD starting.

But the problem with a criminal case for fileswapping is you have to prove beyond reasonable doubt and many defenses could shield the person. For example you would have to prove that the person never own the song in any format before. That alone makes criminal proceeding almost impossible.

The civil cases that we have seen have all been settlement thus far as it's not worth fighting court. Civil court you win based on your pile paper compared to thier pile. If yours is bigger you win.
