The Courts have NEVER declared P2P illegal

The RIAA has been granted injunctions against file-sharers and file-sharing software producers. But none of them has ever come to trial because the RIAA is scared of what could happen. If the RIAA loses in court, the precedent could leave them impotent to charge others with the same crime -- and you *never know* what a jury might decide. Could be a couple of file-sharers on the jury might sway it toward a "not guilty" verdict, and that would cripple the RIAA.

So instead, the RIAA or MPAA will get an injunction against a company then delay the process until the company runs out of money. Or they will get an injuction against a person and then offer a "deal" to get out from under millions of dollars in possible fines. Who wouldn't pay $2,000 to avoid possibly owing $2,000,000?

But for the time being, no U.S. court has declared file-sharing illegal. One might presume it's illegal, but that hasn't been proven.
