What about the money?
Are you prepared, as a tax-payer, to fund the trials of these "criminals"? The criminal justice system doesn't have sufficient bandwidth now to accomodate the truly dangerous (murderers, rapists, armed robbers, burglars) or sufficient resources to prosecute the massivly larcenous (Enron, Worldcom, Global Crossing, etc.) so let's go after 40,000,000 otherwise law-abiding citizens. It is obviously not an option. Any kid who is downloading can figure this out if you can't. That renders the threat of prosecution for any particular individual virtually non-existant. I don't know if you have any teenagers, but rebellion and a sense of invulnerability are part of the package. The Recording Industry is OBSOLETE! They should cry in their beer with the buggy-whip manufacturers.
