One of the great attractions of international
maritime law is the simple fact that each case
which comes to trial has the potential for making
new law. This is a very big deal for attorneys
and judges. Perhaps we need national and
international internet law? Create a new field
and it will attract some very good minds.
Currently, if your business connects to the
internet, it is on its own. Any and every virus,
worm, and/or other exploit can immediately attack
your business. If any of them are successful,
you have no recourse. In the marine industry, if
you are permitted to tie your boat or barge to a
dock or barge fleet, the owner of that dock or
barge fleet is required to exercise reasonable
care to prevent your vessel from coming to harm.
If another vessel, passing up or down river
strikes your vessel or causes damage because of
its wake, you and the dock or fleet owner have
recourse. If you 'dock' your business to an ISP,
there are no requirements on that ISP to exercise
any kind of care at all to protect your vessel,
your business, from harm. Nor is there a
reliable way of even identifying a malicious
'vessel' passing up or down the internet 'river'
which causes damage to the vessel which is your
company, let alone having effective recourse.
This is an insane environment to operate in.
Change is desperately needed and I fear that
change, when it comes, will be draconian.
