MS' own fault
Instead letting anyone use the algorithm with no strings attached (which would have accomplished Bill Gates' stated goal with little or no cost to MS), MS decided to get cute and attach license terms to it that no open source developer could accept. Yes, that was MS' perogative, but by doing so, they made if very clear what their real goal was and it wasn't spam eradication.

T'is a pity, but that's what happens when you're caught negotiating in bad faith.
