Criminals may not be so fastidious.
Many of the more successful worms worked on vulnerabilities which had already been patched. Or would have been if users had installed the patch.

Criminals, I suspect, care less about battles of wits with those designated to oppose them than about being successful.
If that success comes from a weakness of human nature, they wouldn't be unhappy. Weaknesses in human nature last far longer than software flaws.
