Justly assigning blame doesn't grant absolution. I'll give an example. A lawyer friend of mine litigated for a family in which the wife was murdered by moving company personnel in an apartment building. The murderers were convicted, but George obtained a substantial award (at the time, the largest jury award in the country) against the apartment management, by convincing the jury that the apartment complex had not lived up to its obligation to provide adequate security.

I'm not going any further with this, merely to assert that the blame you rightly assign does not automatically close the case.
