The reason for the judgement has to do with the way the defense argued. Namely, the creator of the Sasser virus created something that had a known solution. This meant the Sasser virus should not have hit at all because Microsoft put out the bulletin earlier.

This is why most likely no company will go after him with a civil action lawsuit. It would mean admitting that their administrators were not doing their jobs. That in turn would open up tons of share holder class action lawsuits!
