First of all, it ain't that easy.
Second, the FBI will be able to crack the encryption eventually... at least by the time the case goes to court.
Third, there will be at most, a dozen different encryption techniques used. How long do you think those will last? A few months? Get real, they'll be cracked or admitted or spyed or whatever.
